Welcome to DolarLess LLC (“DolarLess,” “Seller,” “we,” “us,” or “our”). These Website Terms & Conditions and Terms of Sale (“Terms”) govern your access to and use of the DolarLess website, your purchase of products through our website, and any other transaction conducted through our online store.

By accessing, browsing, registering on, or purchasing Products through our website, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, please do not use the website or place an order.

1. ABOUT DOLARLESS

DolarLess LLC operates an online marketplace and retail business offering various new, used, pre-owned, surplus, discontinued, refurbished, collectible, vintage, and other merchandise (“Products”).

Because our inventory may consist of individual or limited-quantity items, Products may vary significantly in age, condition, availability, packaging, accessories, and functionality.

Each Product listing is intended to provide information about the specific item being offered for sale. Buyers are responsible for carefully reviewing the complete Product description, photographs, specifications, condition information, included accessories, and any applicable disclaimers before placing an order.

2. ACCEPTANCE OF THESE TERMS

By placing an order through the DolarLess website, you represent and warrant that:

1. you are legally capable of entering into a binding agreement;

2. the information you provide is accurate and complete;

3. you are authorized to use the payment method submitted with your order;

4. you have reviewed the Product description and condition before purchasing; and

5. you agree to these Terms and all applicable DolarLess policies.

These Terms constitute a binding agreement between you (“Buyer,” “Customer,” “you,” or “your”) and DolarLess.

DolarLess reserves the right to update these Terms from time to time. The version of the Terms in effect when an order is placed will generally govern that transaction, unless otherwise required by applicable law.

3. PRODUCT DESCRIPTIONS AND PHOTOGRAPHS

DolarLess makes reasonable efforts to provide accurate Product descriptions, photographs, measurements, specifications, and condition information.

However, photographs may not always accurately represent the actual color, appearance, scale, or condition of an item due to lighting, photography equipment, display settings, image compression, or other factors.

For used, pre-owned, vintage, surplus, collectible, discontinued, or otherwise previously owned Products, photographs are an important part of the Product description.

BUYERS ARE RESPONSIBLE FOR REVIEWING ALL PRODUCT PHOTOGRAPHS, DESCRIPTIONS, SPECIFICATIONS, AND CONDITION INFORMATION BEFORE PURCHASING.

Minor cosmetic imperfections, scratches, dents, discoloration, fading, wear, marks, missing labels, aging, packaging damage, or other ordinary signs of prior use may exist unless specifically stated otherwise.

Unless expressly stated in the listing, DolarLess does not guarantee that a Product will include original packaging, manuals, accessories, cables, batteries, software, documentation, certificates, or other components.

4. NEW, USED, PRE-OWNED, SURPLUS, AND AS-IS PRODUCTS

Products sold by DolarLess may be offered in different conditions, including:

• New;

• Open-box;

• Refurbished;

• Used;

• Pre-owned;

• Vintage;

• Surplus;

• Discontinued;

• Salvage;

• Collectible; or

• AS-IS / WHERE-IS.

The condition stated in the individual Product listing controls for that particular Product.

AS-IS / WHERE-IS SALES

Unless a Product listing expressly states otherwise, Products identified as **“AS-IS,” “WHERE-IS,” “USED,” “PRE-OWNED,” “SURPLUS,” or similar condition designations are sold without any express or implied warranty regarding performance, functionality, merchantability, fitness for a particular purpose, or suitability for Buyer’s intended use, to the maximum extent permitted by applicable law.

AS-IS PRODUCTS MAY HAVE KNOWN OR UNKNOWN DEFECTS, COSMETIC DAMAGE, MISSING COMPONENTS, WEAR, AGING, OR FUNCTIONAL LIMITATIONS.

Buyer accepts the Product in its stated condition and assumes responsibility for determining whether the Product is suitable for Buyer’s intended use.

DolarLess does not provide technical support, installation services, calibration services, engineering services, maintenance services, or ongoing technical assistance unless expressly stated in writing.

5. PRODUCT FUNCTIONALITY AND TESTING

Unless expressly stated in a Product listing, DolarLess does not represent that used or pre-owned Products have been fully tested.

If testing has been performed, the Product listing may identify the testing performed and the results known to DolarLess at the time of listing.

A statement such as “tested,” “powers on,” “appears functional,” or similar language does not constitute a guarantee that the Product will perform every function or satisfy Buyer’s particular requirements.

Buyer is responsible for independently determining whether a Product is appropriate for its intended application.

For specialized, technical, scientific, electronic, industrial, medical, laboratory, or other equipment, Buyer is responsible for obtaining any required professional inspection, testing, certification, calibration, installation, or approval before use.

6. PRICING AND PRODUCT AVAILABILITY

All prices are stated in U.S. dollars unless otherwise indicated.

Prices, availability, descriptions, specifications, and promotions may change without notice.

DolarLess reserves the right to correct pricing, typographical, inventory, description, or other errors.

If an order is placed based on an obvious pricing, description, or inventory error, DolarLess may cancel the order and issue a refund of any amount paid.

Because some Products are unique or available in limited quantities, placing a Product in a shopping cart does not guarantee that the Product will remain available until checkout is completed.

7. ONLINE ORDERS

Submitting an order through the website constitutes an offer by Buyer to purchase the selected Products.

An automated order confirmation confirms receipt of the order but does not necessarily constitute final acceptance of the order.

DolarLess reserves the right to accept, reject, cancel, or limit an order for legitimate business reasons, including:

• Product unavailability;

• pricing or listing errors;

• suspected fraud;

• payment problems;

• shipping restrictions;

• inaccurate customer information;

• duplicate orders;

• inventory discrepancies;

• suspected misuse of the website; or

By submitting payment information, you authorize DolarLess and/or its payment processor to charge the applicable amount to your selected payment method.

You represent that you are authorized to use the payment method provided.

DolarLess does not store complete credit or debit card information on its own systems when payment processing is handled by a third-party payment processor, except as otherwise disclosed in the applicable Privacy Policy.

9. PAYPAL TRANSACTIONS AND PAYMENT DISPUTES

When Buyer chooses PayPal as a payment method, the transaction may also be subject to PayPal’s applicable terms, policies, dispute procedures, and buyer or seller protection programs.

DolarLess cannot control or override decisions made by PayPal concerning a PayPal dispute, claim, chargeback, payment hold, or other payment-related matter.

PayPal’s policies may provide protections or remedies that are separate from DolarLess’s return and refund policies. PayPal determines eligibility under its own applicable rules.

Buyer agrees to provide accurate information and cooperate reasonably with DolarLess and the applicable payment processor when investigating payment disputes.

10. SALES TAXES

DolarLess will collect and remit sales tax or other transaction taxes when required by applicable law.

The amount of tax charged may depend upon the shipping destination, applicable tax laws, and the type of Product purchased.

Tax-exempt purchasers must provide valid exemption documentation before or during the applicable transaction when required.

11. SHIPPING AND DELIVERY

DolarLess will ship Products to the address provided by Buyer during checkout.

Buyer is responsible for providing an accurate and complete shipping address.

DolarLess is not responsible for delays or additional costs caused by:

• incorrect or incomplete addresses;

• refused deliveries;

• failure to retrieve a package;

• carrier delays;

• weather;

• natural disasters;

• customs delays;

• government restrictions;

• strikes;

• transportation disruptions; or

• other circumstances beyond DolarLess’s reasonable control.

Shipping Estimates

Any shipping or delivery date displayed on the website is an estimate unless expressly stated as a guaranteed delivery date.

DolarLess will make reasonable efforts to ship orders within the time stated in the applicable Product listing or checkout information.

Federal law requires online sellers to have a reasonable basis for advertised shipping times and generally requires additional notice and refund options when an order cannot ship within the promised time.

If DolarLess becomes unable to ship an order within the applicable promised period, DolarLess will provide the notices, delay options, cancellation rights, and refunds required by applicable law.

12. SHIPPING DAMAGE AND LOSS

Buyer should inspect the package and Product promptly upon delivery.

If a package arrives visibly damaged, Buyer should photograph the package and Product before disposing of any packaging materials and promptly notify DolarLess.

Where appropriate, DolarLess may require photographs, shipping documentation, or other information to process a shipping-damage claim.

Responsibility for loss or damage during shipment may depend upon the applicable carrier, shipping method, transaction terms, and applicable law.

DolarLess will reasonably cooperate with Buyer in pursuing an appropriate carrier claim when applicable.

13. INTERNATIONAL ORDERS

DolarLess may offer international shipping to selected countries.

International orders may be subject to additional restrictions, including:

• customs requirements;

• import restrictions;

• export restrictions;

• duties;

• tariffs;

• brokerage charges;

• customs fees;

• value-added taxes;

• other governmental charges; and

• carrier-specific requirements.

Unless expressly stated otherwise, Buyer is responsible for all customs duties, import taxes, tariffs, brokerage fees, and other charges imposed by the destination country.

DolarLess cannot guarantee that a Product will be permitted to enter the destination country.

Buyer is responsible for determining whether the Product may legally be imported, possessed, used, or resold in the destination country.

DolarLess may refuse or cancel an international order if shipment would violate applicable law, sanctions, export controls, carrier restrictions, or other legal requirements.

14. RETURNS AND RETURN AUTHORIZATION

DolarLess’s return policy depends upon the Product listing and the reason for the requested return.

A RETURN IS NOT AUTHORIZED MERELY BECAUSE A BUYER CHANGES HIS OR HER MIND UNLESS THE APPLICABLE PRODUCT LISTING EXPRESSLY PERMITS SUCH A RETURN OR APPLICABLE LAW PROVIDES OTHERWISE.

Buyer must contact DolarLess before returning any Product.

Unauthorized returns may be refused or delayed.

When a return is approved, DolarLess will provide return instructions.

Buyer is responsible for securely packaging returned Products and, unless otherwise agreed or required by law, for return shipping costs associated with voluntary returns.

15. NON-RETURNABLE PRODUCTS

Unless otherwise required by applicable law, certain Products may be non-returnable, including Products that are:

• sold explicitly as non-returnable;

• sold on an AS-IS basis;

• used or pre-owned and specifically identified as final sale;

• damaged after delivery;

• modified or altered after delivery;

• missing components or accessories included at the time of shipment;

• opened where the listing states that opened Products cannot be returned;

• purchased through a liquidation, clearance, auction, or similar final-sale transaction;

• custom-made or specially configured;

• contaminated or unsuitable for return due to health, safety, or regulatory considerations; or

• otherwise identified as final sale in the Product listing.

Nothing in this section limits rights that cannot lawfully be waived.

16. WRONG ITEM, DAMAGED ITEM, OR MATERIAL MISDESCRIPTION

If DolarLess ships an item that is materially different from the Product ordered, or if an item arrives damaged due to shipping, Buyer should notify DolarLess promptly and provide photographs and other requested documentation.

If DolarLess determines that the Product was materially misdescribed or that DolarLess shipped the wrong Product, DolarLess may, at its option and subject to applicable law:

1. provide a replacement, if available;

2. authorize a return and issue an appropriate refund; or

3. provide another reasonable remedy.

Minor cosmetic differences that are accurately disclosed in the Product listing do not constitute a material misdescription.

17. REFUNDS

Approved refunds will generally be issued to the original payment method used for the transaction, unless otherwise required by law or agreed by DolarLess.

The time required for a refund to appear in Buyer’s account may depend upon the payment processor, bank, credit-card issuer, or other financial institution.

Where DolarLess is legally required to provide a refund because an order cannot be shipped as promised, DolarLess will provide the applicable refund in accordance with applicable law.

DolarLess will not substitute store credit for a refund when applicable law requires a monetary refund.

18. RESTOCKING FEES

Where permitted by applicable law and disclosed in the applicable Product listing or return policy, DolarLess may charge a reasonable restocking or handling fee for voluntary returns.

No restocking fee will be applied where prohibited by law or where DolarLess is responsible for the return because the Product was materially misdescribed or the wrong Product was shipped.

19. WARRANTY DISCLAIMER

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOLARLESS DISCLAIMS ALL WARRANTIES THAT ARE NOT EXPRESSLY PROVIDED IN WRITING.

FOR USED, PRE-OWNED, SURPLUS, VINTAGE, COLLECTIBLE, AS-IS, OR FINAL-SALE PRODUCTS, THE PRODUCT IS SOLD IN ITS STATED CONDITION, AS-IS AND WHERE-IS, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

DOLARLESS DISCLAIMS IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXCEPT TO THE EXTENT SUCH DISCLAIMERS ARE PROHIBITED BY APPLICABLE LAW.

DolarLess does not guarantee that any Product will:

• satisfy Buyer’s particular requirements;

• operate without interruption;

• perform at a particular capacity;

• be compatible with Buyer’s equipment or systems;

• remain available for future use;

• retain its original manufacturer specifications;

• be suitable for a particular application; or

• remain supported by the original manufacturer.

20. TECHNICAL, INDUSTRIAL, SCIENTIFIC, ELECTRONIC, AND SPECIALIZED PRODUCTS

Certain Products sold through DolarLess may be technical, industrial, scientific, electronic, laboratory, commercial, mechanical, or otherwise specialized equipment.

Buyer acknowledges that such Products may require professional installation, inspection, testing, calibration, certification, maintenance, or operation.

DolarLess is not responsible for determining whether a Product is suitable for a particular technical application.

Buyer is solely responsible for obtaining qualified professional advice when appropriate.

21. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOLARLESS’S TOTAL LIABILITY ARISING FROM OR RELATING TO A PRODUCT PURCHASE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY BUYER TO DOLARLESS FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOLARLESS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF USE, LOSS OF DATA, INTERRUPTION OF BUSINESS, COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR OTHER SIMILAR DAMAGES.

This limitation applies regardless of the legal theory asserted, including contract, warranty, negligence, strict liability, or otherwise, except to the extent such limitation is prohibited by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

22. BUYER RESPONSIBILITY

Buyer is responsible for:

• reviewing Product information before purchase;

• selecting Products appropriate for the intended purpose;

• providing accurate billing and shipping information;

• inspecting Products upon receipt;

• following applicable manufacturer instructions and safety requirements;

• obtaining professional advice when necessary;

• complying with applicable laws and regulations; and

23. PROHIBITED USES

1. violate any applicable law or regulation;

2. commit fraud or facilitate fraudulent transactions;

25. USER-SUBMITTED CONTENT

By submitting content, you grant DolarLess a non-exclusive, worldwide, royalty-free right to use, reproduce, display, publish, modify, and distribute the content for legitimate business and promotional purposes.

DolarLess reserves the right to remove content that is unlawful, abusive, defamatory, misleading, fraudulent, obscene, or otherwise inappropriate.

30. CANCELLATION BY DOLARLESS

If there is a conflict between these documents, the following order of priority shall apply unless applicable law requires otherwise:

1. mandatory applicable law;

2. specific written terms expressly agreed to by DolarLess;

3. the applicable Product listing;

4. the applicable order confirmation;

5. these Website Terms & Conditions;

6. DolarLess’s general policies.

40. CHANGES TO THESE TERMS
